Court Throws Out San Diego's
Inclusionary Ordinance
On Wednesday, Superior Court Judge John Meyer
ruled that the City of San Diego's inclusionary housing ordinance is
unconstitutional. He said that the ordinance did not include the appropriate
waiver provisions that were set forth in the Homebuilders vs Napa County
suit. In the same ruling the judge dismissed all of the other points of
the BIA's challenge of the entire ordinance.
The city Council will consider their response to
the ruling at their meeting on Tuesday afternoon at 2:00 PM. The City Attorney
has prepared an amendment to the ordinance that would bring it into compliance
with the ruling. There are other legal options that will be
considered as well.
Inclusionary legal experts from around the state
have privately indicated that the ruling is not as apocalyptic as it first
seemed and it appears that there is time to react in a measured fashion.

The 11th Annual Affordable Housing and
Community Development Recognition Awards will be held in less than two
weeks, on Wednesday, June 14, 2006. The event starts at 5:00 PM with
heavy appetizers, a cash bar and a silent auction. The silent auction will be
a great chance to get bargains on Padre tickets, golf, golf clubs, restaurant
gift cards, sports memborabilia and more. Come early and bid often.
The ceremony will inlcude opening remarks by
Father Joe Carroll and some folks that have been helped by his housing
programs. This will be followed by the presentation of the awards. As usual,
the door prize of a free ticket anywhere Southwest Airlines flies will be
given to one of the attendees.

Chamber to Present to Land
Use & Housing
The Housing Committee of the San Diego Regional
Chamber of Commerce will present an update on the Chamber’s Housing Action
Plan to the City of San Diego's Land Use and Housing Committee on Wednesday,
